Cachée
Terms and Conditions
By applying to be a Member, purchasing or receiving a Weekend Pass, reserving a hotel room or reserving a table, You agree to be bound by these terms and conditions (‘the Terms & Conditions’).
The Terms & Conditions may vary from time to time, please make sure You review them regularly (at least before each application, purchase or receipt) and print a copy at the time of agreement.


1.1. DEFINITIONS AND INTERPRETATION
For the purposes of these Terms and Conditions reference to the following terms will have the defined meanings therein:
Independent Contractor(s) includes (without limitation) third party business partners, outsourced workers and venue operators.
Event(s) means the Cachée event specified by the Weekend Pass.
Guest(s) means any person present at any Cachée event.
Member(s) means any person with approved Cachée membership.
Weekend Pass(es) means a ticket to a specified Cachée Event.
Weekend Band means the wristband which allows a Weekend Pass holder to gain entry into an Event.
Cachée
Cachée is operated by The VIP Group Limited, a Maltese company, registered at Matilda Court, 2 Giuseppe Cali Street, Ta’ Xbiew, Malta, XBX 1423.
H Hotel & Spa
H Hotel & Spa is operated by HH Operating Ltd, a Maltese company, registered at St. Augustine Street, St. Julian's. Malta


1.2. MEMBERSHIP

Applications
You agree to provide full and accurate information in respect of your membership application.
Applicants must be at least 18 years of age.

Membership
You must have been approved for Cachée membership (i.e. be a Member) in order to be entitled to purchase and/or benefit from a VIP Pass.

Membership cancellation
If You wish to resign as a Member you should notify Cachée by email to info@cacheeworld.com. Please clearly identify the subject of Your email as membership cancellation.

Suspension and expulsion
You will automatically and immediately cease to be a Member (unless otherwise stated in writing by Cachée at its sole discretion) if:
– You become of unsound mind and present as a danger or disturbance to other Guests;
– You are convicted of any criminal offence;
– You behave in a manner which, in the opinion of Cachée, is injurious to the reputation, character and interests of the Cachée;
- You do not comply with these Terms & Conditions.


1.3. WEEKEND PASSES

Weekend Passes
Subject to these Terms & Conditions, issuance of a Weekend Pass entitles You entry to the specified Cachée Event during the specified period.
For the avoidance of doubt, Weekend Passes will not be issued until payment (or other consideration as agreed in writing by Cachée) is received by Cachée.
Weekend Passes purchased from unauthorised vendors or sources will be invalid.

Collection of VIP Bands
Your Weekend Pass will be used to collect your Weekend Band upon email instructions from Cachée. Unless otherwise communicated to You, Your Weekend Pass and photographic identification will be required at the time of collection of your VIP Band. In the event that You lose or misplace Your Weekend Pass, a replacement VIP Pass can be purchased for a fee of £50.

For the avoidance of doubt, Weekend Bands will be used to identify Weekend Pass holders for entry into each Event and You must wear your Weekend Band at all times during each Event.
Cachée will not issue duplicates for lost or damaged Weekend Bands.

Entry refusal
During any Cachée event (or in respect of any circumstances which reasonably relate to Cachée) You must, at all times, act in accordance with the provisions of these Terms and Conditions, including (without limitation) the Dress Code, Behaviour and Identification clauses.
In the event that You fail to comply with these Terms & Conditions, Cachée reserves the right to refuse admission to any Event at its sole discretion (and without prejudice to Cachée’s rights generally).

Event Changes
Weekend Passes are issued subject to Cachée’s right to alter or vary the Events calendar. If an Event is rescheduled, Your VIP Pass will be redeemable in respect of the rescheduled event.
Billed Event attractions and/or performances may be subject to change.

No refund, transfer, sale or promotion of Weekend Passes
Weekend Passes are non-refundable.
You acknowledge that Weekend Passes and Weekend Bands are issued for personal use only and may not be transferred, offered for sale or resold. Weekend Passes and Weekend Bands cannot be used as any marketing or sales promotion without Cachée’s prior written consent.

Attempts to transfer, resell or use a Weekend Pass or Weekend Band obtained through an unauthorised promotion may result, at Cachée’s discretion, in You being refused entry to or ejected from any Event without refund or other remedy.


1.4. HOTEL RESERVATIONS

H Hotel & Spa
H Hotel & Spa hereby affirms that it operates solely by itself, without any involvement, oversight, or control from Cachee. All business decisions, operations, and management of H Hotel & Spa are conducted independently by H Hotel & Spa.
Cachee shall not be liable for, and holds no responsibility for, any actions, omissions, damages, losses, claims, liabilities, or expenses arising out of or in connection with the operations, services, or management of H Hotel & Spa. This includes, but is not limited to:
a. Any services provided by H Hotel & Spa to its clients and customers.
b. Any contractual obligations or disputes involving H Hotel & Spa.
c. Any claims made by third parties against H Hotel & Spa.
d. Any financial losses or operational issues experienced by H Hotel & Spa.
Cancelation Policy
All room bookings are Non-refundable.

1.5. TABLE RESERVATIONS

Minimum Spend
Tables at Cachée are reserved on a minimum spend basis. The minimum spend is the minimum amount You and Your party commit to spending to guarantee the table reservation.
The minimum spend sum can only be spent on drinks from the table menus provided at the specified event.

Prices
Table prices are subject to change during the season as per Cachée’s discretion. Cachée is not obligated to notify Guests of price changes for other tables or reduce the price of any previously booked tables in the event that the price for other similar tables are reduced at a later time.

Payment
Table reservation payments are charged in the local currency of Euros. Cachée is unable to specify the amount taken in other currencies; Your bank will determine this rate.

Non-refundable
Any table payments are non-refundable.

Table security
Please keep Your belongings safe at each Event as Cachée cannot be held responsible for any damaged, lost or stolen alcohol or personal items.


1.6. EVENTS

Media
All media created at any Cachée event will be the intellectual property of Cachée.

By entering a Cachée event, You consent to being photographed or filmed and You consent to resulting materials being used for commercial distribution, publication and Cachée communications, without payment, copyright or other intellectual property rights in your favour.

Please note that SLR and other professional (or equivalent high grade) video cameras or equipment are not permitted at any times. If You wish to record at a Cachée event please contact Cachée in advance at info@thevipclubmalta.com.

Dress Code
Cachée reserves the right to refuse admission if You are dressed inappropriately for an Event. Although Cachée does not operate a formal dress code for Events, Guests are asked to dress luxuriously and You agree to adhere to dress code policies outlined on the website and Event marketing material (policies may vary between events).

Behaviour
You agree to act and drink responsibly and acknowledge the need to keep hydrated during Events.

You agree not to behave in a manner (whether at Cachée events or in respect of any circumstances which reasonably relate to Cachée) which, in the opinion of Cachée, is injurious to the reputation, character and interests of the Cachée.

Cachée reserves the right (without prejudice to Cachée’s rights generally) to refuse admission to and/or eject any person appearing intoxicated, under the influence of drugs, or otherwise behaving dangerously or inappropriately at any Event. No refunds or remedies will be given under these circumstances.
Any violent, threatening or abusive acts against staff, Independent Contractors or other Guests may result in a life ban from Cachée events. The necessary legal action will also be pursued where appropriate.

Security
To ensure safety at Cachée events, Cachée reserves the right to conduct security searches of clothing, bags and all other items and the right to confiscate items, which may cause danger or disruption to others. Security have the right to remove any persons from an Event for unacceptable behaviours.

Lost Property
Each Guest is responsible for their belongings when attending Cachée events. Cachée does not accept any responsibility for any personal property whether lost, damaged, stolen or otherwise.

Food & Drink
Food and drink purchased elsewhere may not be consumed inside of an Event. It is not permitted to take any bottles or drinks outside of the Events.

Capacity Limitations
You are advised to arrive as early as possible to Events. In the event that venue capacity is reached at any Event, Cachée reserves the right to refuse entry even with a valid VIP Pass/VIP Band.

Property
You are not permitted to take any property from any Cachée event or associated venue which is not owned by You without prior permission. Any Guest found to have taken such property will be fined and reported to the local authorities.

Identification
All Members must be at least 18 years of age to gain entry into any Cachée Event. Cachée and any Independent Contractors reserve the right to request personal identification for proof of age (or similar) purposes.


1.7. TRAVEL INSURANCE

You are solely responsible for purchasing travel insurance to cover You during Your trip and the Events. Please ensure Your travel insurance is sufficient and covers at least the standard items such as personal injury, death, theft, loss or damage to personal belongings, flight and accommodation bookings, cancellations, etc.


1.8. LIABILITY

In no event shall Cachée be liable to any Guest for any direct, indirect, incidental, special, consequential or punitive damages, or any damages whatsoever, resulting or arising from the performance or non-performance of this agreement.

Cachée will not be liable for any acts or omissions of any Independent Contractors.
Third Party activities that you engage with, such as watersports, are undertaken at Your own risk. Cachée will not be held responsible for any loss or damage to personal items, personal injury or death as a result of such activities.

Any damage caused by You to any premises, items or persons in connection with the Cachée or its Events will be chargeable to You. You agree to compensate Cachée for any liability, claim or damages (including any associated costs) made by a third party in respect of any matter in relation to or arising from any damage caused (directly or indirectly) by You.


1.9. DATA

Compliance
All data that is provided to Cachée is handled in accordance with the General Data Protection Regulation (GDPR) 2018 and Privacy and Electronic Communications (EC Directive) Regulations 2003.

Collected Data
a) Cachée may send You emails, text messages and other correspondence for reasons such as providing You with Your VIP Pass, providing Event updates, Cachée marketing materials and other legitimate purposes relating to Your membership, VIP Pass, and Cachée events or products.
b) Your data is stored on third party web and mailing system secure servers.


2.0. GENERAL

Force Majeure
Cachée will not be liable for any failure to perform its obligations under these Terms & Conditions or if an Event is cancelled, altered or postponed due to a any fortuitous or unforeseen occurrence, including an act of god, weather, government restrictions, war, terrorism, civil disorder, interruptions, loss or malfunctions of utilities, communications or computer software and hardware) services or any other emergency.

Entire agreement
These Terms and Conditions represent the entire agreement between you and Cachée and will supersede any previous Terms and Conditions.
